Default Lo W Ball Settlement Offer Very Upset

Hi. I fell last year on an eleven sidewalk during work. I sustained a concussion. Hearing loss with tinnitus, vertigo, recurrent skin infections of my leg. Limited usage of my dominant hand. And multiple cervical disc herniation. They came back with a 40k offer section 20. Leaving me with only $31k when it is all said and done and no chance of reopening the case should I need surgery down the line
Do they always low ball the first offer? Should I go to court and fight this? The judge I have now is retiring. Do I get a chance to speak with the judge to explain my injuries? Could he agree with me and offer me more money? Should I take a section 22 ? Would I make out better with that ?

Don't mess with it, consult and retain a lawyer before proceeding further.

Yes, you need the help of a good workers' comp lawyer. These cases are not DIY, and you have a complicated set of injuries. Depending on whether you can work or not due to the injuries, your case could be worth a whole lot more than that amount. But you will never, ever get what it is worth without a good lawyer. So choose your lawyer carefully and thoughtfully. Do your research. Don't hire a lawyer based on seeing his or her ad on TV or a billboard--do your homework first.

I have posted elsewhere on this forum the online resources you can use to investigate and research lawyers. I think Tony made it a sticky.
The North Carolina Court of Appeals has held that "In contested Workers' Compensation cases today, access to competent legal counsel is a virtual necessity." Church v. Baxter Travenol Labs, Inc., and American Motorists Insurance Company, 104 N.C. App. 411, 416 (1991).
