Just Dealing with What is Handed You

I have determined that if the I.C. has accepted your claim, attorney's don't really want anything to do with you. I have talked to two myself, and it isn't like they are telling me I need representation, even though the Dr. basically made my condition worse, lied about my deteriorated condition as if it was MY fault, and avoided taking notes on two appointments I had and didn't even know he forgot to...he passed me onto another physician saying he couldn't help me, when he is the specialist?

The Before you post statement is hilarious. Like it isn't bad enough already.....yeah, don't post anything that might give you away like you were injured and need medical care-- good medical care is not going to happen, and there isn't anything you can do about it. Your employer will totally mess with you if they know you are not happy with the way they treated you or how WC has.
It does not matter what happened to you. What matters is that all the people involved with your injury placate the Ins. Company, even if it is at your detriment.

This is what books are made of. Books do not, however, change the system.

So..ultimately God will determine every persons actions or in action. Justice in this lifetime is not likely.

I have handled plenty of accepted claims. Some lawyers will only handle accepted claims, but the better ones take denied cases too. If a lawyer does not want to represent you on your case, there is another reason than the fact that it is accepted.

I just felt like the attorneys I talked to gave me good advice, but maybe they thought all would be well..
I liked that, I feel it helped me. The issues with my employer taking my pay and stuff they cannot do anything about. That is internal.
Do I really want to file retaliation against my employer when I want to work for them?
The issues with Salary continuation that would have stopped any of the problems with my pay to begin with are water over the bridge.
The attorney told me I could get a second opinion, I just have to file for it. As far as a tort claim-- which I believe neglect was involved -- Who wants to go there? I think it is just too much hassle for anyone to want to deal with especially when it is The State. That's why I just said to myself, okay, they caved...I am alone.

Who committed the tort? If your employer or a co-worker committed the tort, you are limited to workers' compensation. You would have no tort claim against them. But you could have a tort claim against an unrelated third party whose negligence caused the accident and injury.

Not everyone is going to need a lawyer. Sometimes the insurance company does everything correctly. Sometimes.

Almost a third party? Still a state entity but contracted by my department. Separate but still under the umbrella.

I worked for the DOD, and along with my WC, I had to go against the Feds, and UIC, to name a few....It took 8 1/2 years, every waking moment of those 8 1/2 years was worth it to me!
If I had to go through that HELL again, I would do the same! best of luck

Thanks airdale. I do feel as though I am at war. My family is vexed by my continuous cries for justice, they tell me nothing will happen with all of my work.
My employers stole my earned wages because they (or one person who knows they screwed up) feels like I owe them for receiving benefits. (When I asked them for Salary Continuation they did not even send letter per policy to consider me) I mean I was actually told (by this person who I think might me crazy but is in charge of my pay) that they worked things out with the third party to take away my earned wages because I made too much before I was injured. This is a battle for sure. I like being pushed to research, to find the truth of how employees are actually paid more transparent. I just hope someday this craziness will end, so that I can actually work again as a ...year employee...and maybe get someone in human resources that is not out to just take peoples money as if that is his main goal, not dealing with the reality of the people he is there to serve.

Wheely, if your state employer contracted with another entity, and that entity caused your injury, you may have a claim against that entity simply because it was not your direct employer. It may be worth discussing with a lawyer who handles both workers' comp and PI (tort) claims. You can always send me an email with details in it and I will try to give you some additional guidance on it.
