    Angry Can You Request Changing Insurance Adjusters

    I was hurt at work six months ago and from the very beginning the adjuster either is horrible at his job or has been told by the company to do what he has been doing, which is basically nothing but avoiding emails and calls. I've been sent to an IME who basically gave me a favorable report stating I need surgery. Also, the case has gone before an arbitrator who again, told the insurance company that if this goes to trial, he will order surgery. So how is it that the insurance adjuster and company can drag this along for months without penalty????? I was legit hurt at work, it has been proven and supported and I just want my life back, and get on the road to recovery. I'm barely getting by supporting my family, having worked 3 jobs before, now I'm only getting 66 percent from the one I was hurt at all because they can claim they were not aware that I had two other jobs. They tried to force me back to work before anyone even had a clue what was wrong because they wouldn't approve tests and clearly they don't care about people. Why are companies allowed to put people through this?

    Because people refuse to consult and retain a lawyer.
    That employer and carrier have a seasoned law firm protecting their interest, don't you deserve the same?
    Without a lawyer, they'll chew you up and spit you out - they know what they can get away with.

    You should've retained a lawyer at the first sign of problems, every day you wait, the further you damage your claim.

    If you are content to deal with them yourself in spite of the downside risks, you can ask to speak to the adjuster's supervisor and complain to that person about the adjuster not returning calls, etc., but you have no clout whatsoever to get them to put another adjuster on your claim.

    Adjusters each have many claims to manage and they don't have much time to spend on any one claim. Every phone call or email you send the adjuster increases the likelihood that you will be put on the adjuster's personal "s*** list" of claimants for whom they will not go out of their way to do anything, simply because you are a PITA.

    Remember, the insurance company is your adversary. They are not your friends. That don't even have an obligation to deal with you in good faith. If you are having problems, hire a lawyer.
