Correct, the employer is free to do whatever they please, they don't have to take you back.
So basically I have to wait for HR and the insurance to decide my fate
If the employer fails to accommodate for any reason, you are then entitled to TTD, wage loss benefits.
If you don't have a lawyer, now's the time to retain one.
