    Default Return to Work Nope

    In California: 2 cases 5 separate injuries.
    So the WC doctors release me back to work, but work won’t accept the work restrictions.
    The work restrictions are the same restrictions I was on while I was working before my surgery.
    At first she said they are looking for a position for me, now she states something about risk of indemnity.
    I am ready to go back to work.
    So basically I have to wait for HR and the insurance to decide my fate?

    Correct, the employer is free to do whatever they please, they don't have to take you back.
    If the employer fails to accommodate for any reason, you are then entitled to TTD, wage loss benefits.
    If you don't have a lawyer, now's the time to retain one.

    *Complex Broken Acetabular

    My workers compensation claim was made in the State of: California

    Am 23 with a complex broken acetabular ....
    It happened on 2/9/18*
    Had surgery 2/13/18*
    Still on workers compensation*
    I was working as a welder in the geothermal business for contractor company ...
    This is how it happened*
    I was working between a concrete building and 40ft 1,500 pound steel pipe sitting on rollers about 3 feet apart.. I was looking to my right when my boss said watch out ..I looked and the pipe was headed right for me trying to jump over the pipe it pinned me crushing my leg and hip together.. pushed my leg right threw my hip joint ...
    Boss said dont pass out I cant carry you ..
    Am a natural big person 6'2 260lbs*
    But that wasn't the problem he didn't want anyone to see me as we were on a job site he helped me to the work truck and said to lie about it on the way to the hospital because if I dont they will fire all of us so he said it happened at our work yard...and I agreed*
    Anyways*
    I got transported from my small town hospital to San Diego 2 hours away*
    I had surgery.
    Plates and screws inserted.
    Fast forward to present day*
    I have one more visit left with my doctor after that he says he is going to release me on disability...
    I have about 7 screws and 2 plates*
    I have bone bruising on my knee still from the accident*
    I have post traumatic arthritis in my hip
    And the doctor is telling me the pain i feel will most likely never go away infact i may need a hip replacement in the future...
    Am 23 married with 1 kid*
    And am very stressed and scared for our future.*
    Could someone tell me what a settlement amount should look like for a case like this or should I even settle ?
    What happens after the doctor releases me on disability? To many questions and I cant find anything compared to my case .

    You need to have a lawyer evaluate your case, no one can answer those questions in an internet forum.
    Find a good lawyer that specializes in Worker Compensation and make an appointment for a free consultation.

    Thanks Tony I have a lawyer but he's kinda hard to get a hold of
    And won't say how much my case is worth he tells me it should be enough for a down payment on a house NOT SURE WHAT MEANS ..
    THIS IS MY FIRST TIME DEALING WITH A LAWYER AND WORKS COMPS
    I JUST DONT WANT TO GET SCREWED
    BECAUSE SOMEONE SEES ME YOUNG AND DUMB

    You have an attorney, your in good hands...To many think they can deal with this on their own and mess it up!....Spend your time and effort healing up, when your MMI you and your lawyer will know much better where you stand and your outcome.
    A heads up, dont think you will ever get rich from a workmans cop case...If your lucky you break even with what you loose.

    Have you been injured at work also?
    Works comp is not a easy thing to deal with
    They had me going in circles and changing adjusters on me .
    I got released from the hospital with no meds on the weekend and the adjuster never approved my prescription medication so I had to pay for my own meds that's crazy to me ...pretty sure it happens all the time
    I think I had 4 adjusters before I decided it was enough and had to get a lawyer .
    If you did deal with works Comp Can you please Share your story with me ?

    THATS THE PROBLEM I KNOW I WILL NOT GAIN MUCH FROM THIS INSURANCE
    I just want a secure future for my family.
