    Default Broken Ankle — Looking for Newbie Advice

    My workers compensation claim was made in the State of: ME

    I broke my ankle slipping on some ice while working. My company knows about it and is filing paperwork.

    No surgery so far, but I meet with my surgeon today. I’m just looking for the advice you’d give a newbie: What kinds of things should I be looking out for? Should I think about getting a lawyer? Are there any documents I should request copies of from my work?

    You should receive paid medical and wage loss without resistance.
    At the first sign of problems, don't argue with the employer or carrier and hire a lawyer.

    DO NOT rely on your employer or its insurance company to protect your legal rights! Your employer and its insurance carrier are your legal adversaries in this process. Find out how to properly file your claim with your state workers' compensation agency and then you get it filed with that agency yourself. That will prevent bad things, like the statute of limitations expiring on you and leaving you without benefits.
    The North Carolina Court of Appeals has held that "In contested Workers' Compensation cases today, access to competent legal counsel is a virtual necessity." Church v. Baxter Travenol Labs, Inc., and American Motorists Insurance Company, 104 N.C. App. 411, 416 (1991).
