    Default Requested Jury Trial to Appeal WC Decision- Defense Wants to Negotiate

    Just found this forum a bit late! However, I could use some assistance with the legal part of my WC case. The final WC hearing ruled that I am not 100 percent disabled and can work in some fashion. My attorney appealed this in circuit court and provided all of the doctors that I have gone to in the past 4 years to give testimony. Now the insurance company wants to settle. How would I know if I am getting a good deal? They have asked me to fill out a form for a company to look into all of my medical bills for the past 4 years so they can put money in a set aside that I will manage on my own. I am asking here because my lawyer hasn't really explained much other than its better to negotiate than go thru a trial. Any advice would be appreciated.

    Well, after long enough, my medicare approved a MSA that was submitted. Does anyone know how long after it is approved that the monetary portion that we agreed upon will be sent to me? I have posted on the Legal page about my lawyer asking for additional compensation because she did a great job. I haven't agreed to it and just wondering if my decision to to pay her more than what the WC systems states is holding up my settlement funds.

    Is that for the financial part to me for settlement? Not the funds put into the set aside.

    Its all one in the same, the money for the MSA and settlement. Its closing out the case.

    Thank you, I am just worried she is holding out because she asked me to give her more money for all of her time spent on my case. I offered some but she came back and wanted 4 times the amount, so I just said lets keep it at what the law says. I haven't heard from her since.

    thanks, but it was never discussed. I agreed to an amount at a mediation. The mediator just said the lawyer would type up the papers. I just though she would have done it by now since it has been over a month. And now the seed money has been deposited for one week and I have no clue how to access it

    How do you know the seed money is deposited? Its been to long for me to remember? I think the seed money was sent via check to me till my structured settlement waited a year to pay out for my MSA.

    I can see it was deposited when I sign into my Medicare.gov account
